				<content:encoded><![CDATA[<p>Charged with aggravated assault for endangering police officers after allegedly stealing an empty gasoline tanker trailer and going on a wild chase, Marc C.J. Chartier failed to appear for his pre-trial conference Tuesday in York County court.</p>

<p>Chartier, of Manitoba, who had a BAC of .216 percent at the time of the alleged crime, posted $25,000 bail days after his arrest through a local bondsman.</p>
<p>Chartier&#8217;s public defender, James Rader, said Chartier told him he could not make his hearing because he was having &#8220;passport problems.&#8221;</p>

<p>The Seven Seals Award &#8212; a Department of Defense award &#8212; is given to recognize employers who support their employees who are in the National Guard or Reserve.</p>
<p>Earlier this year, Lt. Gregory Ickler accepted the ESGR&#8217;s Patriot Award, which is presented to an individual supervisor in recognition of his support of guard and reserve employees.</p>

				<content:encoded><![CDATA[<p>Inside the cab and in the bed of Justin Klingensmith’s wrecked Ford F-150 were a number of empty Red Bull and Mountain Dew containers.</p>
<p>During Klingensmith’s two-day vehicular homicide trial in York County court, the attorneys debated the purpose of Red Bull.</p>
<p>Klingensmith testified he had one in the hours before the crash and that he drank it because he liked the taste.<br />

Vehicular crimes prosecutor Jared Mellott told the jury the crash that killed Melissa Allison occurred after Klingensmith, “had how many energy drinks” to combat his fatigue.</p>
<p>He suggested the jury find Klingensmith’s claim he liked the taste of Red Bull to be “nonsensical.”</p>
<p>Mellott admitted he has never had a Red Bull, preferring coffee as his source of caffeine.</p>
<p>In his closing argument, defense attorney Frank Arcuri brushed aside the prosecution’s implication that there is only one reason to drink Red Bull – to stay awake.</p>
<p>“It’s just another soda,” Arcuri said, “an energy drink.”</p>

<p>Martin&#8217;s family members went to police after Jones told local media how he helped find her body and described the blood-stained walls in her bedroom.</p>
<p>According to Martin&#8217;s family, Jones was not in the bedroom after the house was unlocked.</p>
<p>Jones initially confessed to killing Martin. He said he entered her home through a back door and went to her bedroom. He said he &#8220;blacked out&#8221; but recalled Martin screaming.</p>
<p>Police searched Jones&#8217; home and found Martin&#8217;s cellphone.</p>
<p>Jones recanted his confession, resulting in his trial.</p>

Attorneys for two men serving life sentences for the June 7, 2002 murder of Deena Faye Cunningham have filed petitions for a new trial alleging there is a witness who says another man has confessed to the crime.</p>
<p> <br />
And that man – Wilfredo Rodriguez Jr. – testified for the commonwealth at their trial.</p>
<p> <br />
A York County jury convicted Greg Lee, now 33, and Antonio M. Stauffer, 31, of first-degree murder in 2004 for shooting and killing Cunningham, a 26-year-old part-time bartender, and seriously wounding her boss, Patrick Hatzinikolas, after hours behind the now defunct End Zone Sports Bar on West Market Street. The bar was owned by Hatzinikolas’ parents.</p>

In a petition filed in the York County Judicial Center on Friday, Lee’s attorney, Dawn Cutaia, states she received a copy of a statement made by Dio Garcia to York City Police on April 9.</p>
<p> <br />
In that statement, Garcia maintains that Rodriguez, 34, who currently is serving a life sentence for the April 11, 2008 murder of Omar Maru “Big O” Dowling, a former William Penn Senior High School football star, confessed to shooting Cunningham and Hatzinikolas.</p>
<p> <br />
Cutaia said Friday that the “newly discovered evidence &#8230; is pretty significant.”</p>

“Our argument, of course, is that Wilfredo Rodriguez had the gun and Dio Garcia says he confessed to being the killer,” Cutaia said.</p>
<p> <br />
But, she explained the standard for Lee and Stauffer to get a new trial is “that if a jury had heard Garcia’s testimony, it possibly could have changed the outcome of the trial.”</p>
<p> <br />
She added that even though police had an obligation to share the information with her and Stauffer’s attorney, “it doesn’t mean they (the police and the district attorney’s office) agree with us.”</p>
<p> <br />
Rodriguez had become part of the End Zone investigation when police caught him with the murder weapon.</p>
<p> <br />
He was arrested and charged with firearms violations and receiving stolen property in September 2003 when police found nine weapons in the trunk of his car. Later ballistics testing linked one handgun – a 9mm Taurus semi-automatic — to Cunningham’s death.</p>
<p> <br />
Rodriguez testified at the End Zone trial that he bought the gun from a “drug dealer” he knew only as “Schizz” in the fall of 2002 for $200. The sale was made less than two blocks from the End Zone.</p>
<p> <br />
At trial, defense attorneys had consistently attacked the competency of the police investigation and argued that there were other likely suspects in the killing who were ignored or overlooked by police.</p>
<p> <br />
Those named by the defense included: Cunningham’s former boyfriend; Hatzinikolas’ wife; “Schizz”; the man who allegedly stole the gun from its legal owner two days before Cunningham was killed; Earl “General” Stiell, who allegedly put out a contract on Hatzinikolas’ life over an unpaid drug debt; and Rodriguez.</p>
<p> <br />
Now in private practice, former First Assistant District Attorney Bill Graff, who prosecuted the case, said Friday, “I’m still convinced they did it. Maybe Wilfredo had a more active part in it, but it doesn’t mean they didn’t do it.”</p>
<p> <br />
Cutaia and Stauffer’s attorney, Vincent Quinn, have requested an evidentiary hearing on Garcia’s allegation against Rodriguez and also have requested appointment of a private investigator to interview potential witnesses.</p>
