Proposed ordinance unconstitutional
On August 7th, the Shrewsbury Township Supervisors held a hearing regarding
an ordinance to regulate the land application of sludge. This twelve page
ordinance is virtually the same one that was adopted by the East Brunswick
Township Supervisors. The problem is that East Brunswick is currently
involved in a lawsuit because the ordinance violates state law. Liverpool
Township had a similar ordinance, and lost their case in the Commonwealth
Court.

The group of residents attending the hearing, led by Susan Fox, know that
the ordinance will lead the township into a costly lawsuit which they cannot
win. Yet they still want to see this ordinance pass. Supervisor Fero
indicated that the township attorney has advised the supervisors that the
ordinance is unconstitutional.
The township farmer who appears to be the direct target of this ordinance
has complied with all state and federal regulations and laws.
If Ms. Fox's group wishes to change the regulations, they need to direct
their energy to the state legislators. That is the only way to get the
regulations changed.
The taxpayers of Shrewsbury Township cannot afford another lawsuit, and I am
urging the supervisors not to enact this ordinance.
